LockedOutNow – Terms and Conditions

Welcome to LockedOutNow LLC (“LockedOutNow,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website (lockedoutnow.com) and related services (collectively, the “Platform”).

By using our Platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

1. Overview of Services

LockedOutNow operates an online platform that allows customers (“Users”) to:

• Submit information and photos related to a lockout or locksmith need.
• Receive an AI-generated instant quote.
• Securely book and pay for locksmith services through our integrated payment system.
• Get connected to a licensed, independent locksmith (“Service Provider”) for service fulfillment.

LockedOutNow is not itself a locksmith service provider. All locksmith services are rendered by independent third-party Service Providers who are licensed, verified, and contracted through the “Platform”.

2. Eligibility

By using LockedOutNow, you represent that you:

• Are at least 18 years of age.
• Have the legal authority to enter into this agreement.
• Will provide accurate, truthful, and current information.

You may not use the Platform for any unlawful, fraudulent, or abusive purpose.

3. Independent Contractors

• LockedOutNow connects Users with independent locksmiths.
• Service Providers are not employees or agents of LockedOutNow.
• LockedOutNow does not control how a locksmith performs their work.
• We verify licensing and documentation but cannot guarantee any locksmith's availability, speed, or specific outcome.
• You acknowledge that the locksmith is solely responsible for the services provided to you.

4. Quotes and Pricing

When you submit a service request:

• Our system generates an estimated quote based on your inputs (e.g., photos, job type, time of day, location).
• This quote may be subject to change after inspection by the Service Provider, if additional issues are found.
• You'll be notified before any price adjustment is made.

Price Lock:

If you confirm and lock in your quote within the displayed time window (e.g., 5 minutes), your quoted rate will be honored unless the job materially differs from your description (e.g., wrong address, different “lock” type).

5. Payments

• Payments are processed through Stripe on behalf of LockedOutNow.
• You authorize LockedOutNow to charge your payment method when the locksmith completes the job.
• A temporary hold may be placed when you confirm the quote; the final charge is captured after completion.
• LockedOutNow collects payment from you and remits payment to the locksmith, retaining a service fee for platform use.
• If a job is canceled after dispatch, you may be subject to a cancellation fee to compensate the locksmith for travel or lost time.

6. Cancellations and Refunds

• You may cancel before a locksmith is dispatched at no cost.
• If the locksmith is already en route, a cancellation fee (up to $50) may apply.
• Once a job is completed, payments are final except in verified cases of error, fraud, or failure to deliver service.
• To request a refund, contact [email protected] within 48 hours of the job.

7. Disclaimers

LockedOutNow strives for accuracy but does not guarantee:

• That a locksmith will always be available or arrive within a specific time window.
• That all prices are error-free or identical to in-person quotes.
• The outcome of locksmith work, as these depend on individual locks, tools, and circumstances.

The Platform is provided on an “as is” and “as available” basis.

8. Limitation of Liability

To the maximum extent permitted by law:

• LockedOutNow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost property, damage to locks or doors, or personal injury caused by a locksmith.
• Our total liability for any claim shall not exceed the total amount paid by you for the applicable service.
• You agree that disputes regarding locksmith conduct or workmanship are primarily between you and the Service Provider.

9. User Conduct

You agree not to:

• Misrepresent information about your lockout, address, or payment.
• Harass, threaten, or endanger any Service Provider.
• Attempt to reverse engineer, copy, or misuse the Platform.

We reserve the right to suspend or terminate access for violations of these Terms.

10. Reviews and Feedback

You may submit reviews or feedback about your experience. By doing so, you grant LockedOutNow a perpetual, royalty-free license to use that feedback for marketing or improvement purposes.

11. Dispute Resolution

• Before filing a claim, both parties agree to attempt good faith resolution by contacting [email protected].
• If unresolved, disputes shall be handled via binding arbitration in New York, NY, under the rules of the American Arbitration Association.
• Each party bears its own costs unless otherwise decided by the arbitrator.

12. Indemnification

You agree to indemnify, defend, and hold harmless LockedOutNow, its affiliates, and employees from any claims, losses, or damages arising from:

• Your misuse of the Platform.
• Your interactions with Service Providers.
• Violation of these Terms or applicable laws.

13. Privacy

Your personal information is handled in accordance with our Privacy Policy, available at lockedoutnow.com/privacy.

By using the Platform, you consent to communications (SMS, calls, or emails) regarding quotes, dispatch updates, and receipts.

14. Updates to These Terms

We may modify these Terms at any time. Updates will be posted with a new “Last Updated” date. Your continued use of the Platform after updates constitutes acceptance of the revised Terms.
